US nonresident tax filing

US Nonresident Tax Returns and Form 1040-NR

Canadians and other non-US residents may need a US return when they earn US income, operate a US business, sell US real estate or need to recover excess withholding. Illuminous Accounting prepares the return and coordinates the related forms around the actual residence, income and treaty facts.

Quick answer

Who may need Form 1040-NR?

A nonresident alien may need to file when engaged in a US trade or business, when US tax was not fully satisfied through withholding, or when a return is needed to claim a refund, deduction or credit. Filing requirements are fact specific. Residence tests, income type, business activity, withholding and treaty positions all matter.

Common Form 1040-NR situations

US rental and investment income

Report US-source income, reconcile Forms 1042-S or 1099 and determine whether an election, deduction or treaty position changes the final tax.

US trade or business income

Report income effectively connected with a US trade or business and coordinate related business schedules and disclosure requirements.

FIRPTA withholding and refunds

Report a US real-estate sale, calculate the final tax and claim any available refund where FIRPTA withholding exceeded the liability. Review our FIRPTA withholding service.

Dual-status and treaty positions

Coordinate arrival, departure, substantial-presence and treaty-residence facts, including related disclosures when required.

Documents commonly requested

  • Passport, US tax identification details and residence history
  • US income statements and withholding slips
  • Rental, business or investment income records
  • Real-estate closing statements and FIRPTA forms
  • Prior US returns and relevant Canadian returns

  3. 3. Preparation: reconcile income, deductions, tax, withholding and treaty treatment.
  4. 4. Delivery: review the return, filing instructions and next-year obligations.

Form 1040-NR questions

Who may need to file Form 1040-NR?

A nonresident alien may need the return when engaged in a US trade or business, when US tax was not fully satisfied through withholding, or when filing is needed to claim a refund, deduction or credit. The answer depends on the full facts.

Can Form 1040-NR recover excess US withholding?

It may. The return reconciles the income, withholding and final US tax. A refund can be claimed when eligible withholding exceeds the calculated liability.

Does selling US real estate require Form 1040-NR?

A non-US seller commonly files Form 1040-NR to report the sale and calculate final tax. FIRPTA withholding is a prepayment and may not equal the final liability.

Is Form 1040-NR the same as Form 8840?

No. Form 8840 is a closer-connection statement used in certain residence situations. Form 1040-NR is an income tax return. Depending on the facts, one, both or another filing position may apply. See our snowbird tax and Form 8840 guide.

Can a tax treaty affect the return?

Yes. Treaty provisions can affect how particular income is taxed and whether a disclosure is required. Treaty claims should be matched to residence, income and US activity.
